Griffin Quartz — Refund & Cancellation Policy (No-Refunds)

Effective date: August 18, 2025


Applies to: All quotes, invoices, special orders, fabrication, delivery, and installation services provided by Griffin Quartz (“Company,” “we,” “us,” “our”) to residential and commercial customers (“Customer,” “you,” “your”) in South Florida.

 

Plain-English Summary: Because every project we deliver is custom-fabricated to your exact specifications and incurs immediate material and labor costs, all payments are non-refundable. We stand behind our workmanship and will repair or replace defects as described below, but we do not offer refunds.

 

1) Purpose & Scope

This Policy explains your rights and obligations concerning cancellations, changes, payments, chargebacks, and remedies for custom quartz products and related services purchased from Griffin Quartz. By approving a quote, paying any amount, scheduling a template or installation, or allowing work to begin, you agree to this Policy.

 

2) Key Principle: No Refunds

All sales are final. No refunds will be issued on deposits, progress payments, final balances, materials, fabrication, delivery, or installation—including but not limited to:

  • Special-order slabs from global manufacturers;
  • Custom cuts, edge profiles, sink/stove cutouts, miters, and finishing;
  • Field measurements (templating), shop drawings, and project management time;
  • Scheduled or completed deliveries and installations.

If any portion of your project has begun (e.g., slab ordered, template scheduled or completed, fabrication started), the entire amount paid and/or due is non-refundable. Where repairs are warranted (see §8), Griffin Quartz will repair or replace the defective workmanship as your sole and exclusive remedy; cash refunds are not available.

 

Compliance Note: If any non-waivable cooling-off or rescission right applies under applicable law, that right will be honored; otherwise, this No-Refunds Policy governs.

 

3) Definitions

  • Quartz Products: Engineered quartz slabs and related components we fabricate and install.
  • Templating: Precise site measurement to create shop drawings/CAD for fabrication.
  • Substantial Completion: Installation sufficiently complete for normal use, subject to minor punch-list items.

 

4) Quotes, Orders & Payments

Quotes are based on drawings/measurements you provide; final pricing may adjust after templating.

  • Deposit: A non-refundable deposit (commonly 50%) is due to reserve slabs, schedule templating, and enter fabrication.
  • Progress/Final Payments: As stated on your invoice; final payment is due at installation/substantial completion.
  • Price Changes: If scope changes (edges, cutouts, length, backsplash, waterfall panels, etc.), pricing updates via written change order and must be paid before fabrication/installation proceeds.
  • Taxes/Fees: You are responsible for applicable sales/use taxes, delivery fees, disposal, and access costs (e.g., hoisting).

 

5) Cancellations & Changes

  • Customer Cancellation: You may cancel before templating and slab order, but any deposit to that point remains non-refundable to cover project preparation.
  • Once slabs are ordered, templating is scheduled or completed, or fabrication has begun, the project cannot be canceled and no refunds will be provided.
  • Post-Template Changes: Any changes after templating require a signed change order and may impact cost and schedule; certain changes may be impossible due to slab yield or engineering constraints.

 

6) Fabrication Standards & Natural Characteristics

  • Color/Lot Variation: Engineered quartz is produced in batches; minor variations in tone/vein movement occur. Samples and digital renders are approximate.
  • Seams: Number/location of seams are at our professional discretion for safety, handling, yield, and aesthetics. Seams may be visible and can vary with lighting and vein direction.
  • Cutouts & Clearances: Final locations for sinks, cooktops, fixtures, and accessories must be confirmed in writing before fabrication.
  • Cabinet Readiness: Cabinets must be installed, level, secured, and meet load/tolerance requirements prior to templating; structural reinforcement is customer’s responsibility.

 

7) Site Access, Delivery & Installation

Provide clear, safe access, working utilities, elevator reservations (if any), parking, and a responsible adult on site.

 

We are not responsible for delays caused by site inaccessibility, trades interference, unlevel cabinets, missing fixtures, or building restrictions.

 

Pre-Existing Conditions: We are not liable for pre-existing structural, plumbing, electrical, or wall/floor issues revealed during removal/installation.

 

Damage Limitation: We take care to protect your property, but minor marks from normal installation activities can occur. Our liability for property damage is limited to direct repair costs and will not exceed the contract price.

 

8) Limited Workmanship Warranty (Exclusive Remedy)

Griffin Quartz provides a 1-year limited warranty on installation workmanship from the date of substantial completion. During the warranty period, we will repair or replace installation workmanship defects (e.g., seam separation, adhesive failures) at our expense.

 

Exclusions (non-exhaustive):

  • Improper use, abuse, impact, heat exposure, chemical damage, UV discoloration (for uncovered outdoor use);
  • Movement/settlement of cabinets, floors, walls, or building structures;
  • Damage by other trades post-installation;
  • Normal characteristics such as visible seams, color/lot variations, micro-scratches from daily use, caulk lines;
  • Customer-supplied sinks/cooktops/fixtures that don’t fit field conditions.

Manufacturer Warranties: Many quartz brands provide separate product warranties. Claims under a manufacturer’s warranty are between Customer and manufacturer; we will assist with documentation reasonably available to us.

 

No Refunds Under Warranty: The sole remedy is repair or replacement of defective workmanship; refunds are not available.

 

9) Inspection & Acceptance

At installation, you (or your representative) will have an opportunity to inspect. Any punch-list items must be noted in writing at that time or within 48 hours of substantial completion. Use of the countertops without timely notice constitutes acceptance. Minor cosmetic items will be scheduled for service; this does not delay payment obligations.

 

10) Chargebacks & Collections

Initiating a chargeback or payment reversal on a non-refundable project violates this Policy. We reserve all rights to dispute chargebacks, invoice collection costs, interest, attorneys’ fees, and to record a mechanic’s lien as permitted by Florida law for unpaid balances.

 

11) Force Majeure

We are not liable for delays/failures caused by events beyond our reasonable control (e.g., supply chain disruptions, manufacturing defects, strikes, extreme weather, acts of God, governmental actions).

 

12) Limitation of Liability

To the fullest extent permitted by law, our total liability is limited to the amount you paid for the specific portion of work giving rise to the claim. We are not liable for incidental, consequential, special, or punitive damages, including lost profits or use.

 

13) Governing Law; Dispute Resolution

This Policy and your project are governed by Florida law. Any dispute that cannot be resolved informally will be submitted to binding arbitration in Broward County, Florida, before a single neutral arbitrator, under the rules of a recognized arbitration provider. Class actions and jury trials are waived. Each party bears its own fees unless the arbitrator awards otherwise.

 

14) Severability; Entire Agreement; Amendments

If any provision is found unenforceable, the remainder remains in effect. This Policy, together with your quote/contract, drawings, and change orders, constitutes the entire agreement on refunds/cancellations. We may update this Policy prospectively by posting a revised version with a new effective date.
